I don't mod, but I have joined games where they do, I'm not sticking up for modders, cause god they lag the game alot, but you gotta learn something. I've heard of alot of people against these modders saying that they will be banned from xbox live.... Thats impossible, you are not violating xbox live terms, you are modding the game you are playing, not xbox live (ie: hacking to get free xbox live, hacking to get free arcade games, hacking your gamerscore, etc.). Saying someone will be banned from xbox live for using a mod inside a game is like saying someone will be banned from using a "loophole" on gears 2 to play on casual on one account and hardcore on the other, just to get the hardcore achievement. Or using a cheat on saints row 2 during multiplayer and someone joins your game. Nothing has to be modded to be banned. Use of any hardware or software that is not its intended use is against the ToS. In fact, according to the ToS you have NO legal rights to anything, or any service Microsoft provides. Technically, when you agreed to the ToS upon activation of your Xbox Live account, you pretty much agreed that they can legally ban you for anything they see fit to ban you for. You should really read it through carefully. They can technically ban you for saying Bill Gates is an ass. It is their discretion. Period.

You forgot to sign your last post and why you resurected an old post i don't know, but I'm not scared of microsoft or being banned from xbox live, wow, most of the time they give you a warning anyway plus your just a fake email address away from a new account, so really doesn't matter what "is their discretion" it's just a game.
